This Terms & Conditions applies to the Librainian App (hereby referred to as "Application") for Supported devices or supported platforms, which includes mobile phone, tablet, laptop, smartphone, TV, or any other device where can be accessed by any means that was created by Pinak Venture (hereby referred to as "Service Provider") as a Freemium service. This service is intended for use "AS IS."

1. Acceptance of Terms and Intellectual Property Rights

By downloading, installing, accessing, or using this Application (hereinafter referred to as the "App"), you acknowledge and agree to be bound by all the terms and conditions contained herein. It is strongly recommended that you read these Terms and Conditions carefully before proceeding to use the App. Your continued access or use of the App signifies your complete understanding, acceptance, and agreement to comply with these Terms, as well as all applicable laws and regulations. If you do not agree with these Terms, you must discontinue the use of the App immediately and remove it from your device.

By installing or using the App, you acknowledge that the Service Provider retains full ownership of the App and all intellectual property rights associated with it. You further agree that the App, including but not limited to its content, features, layout, interface, underlying source code, databases, design elements, and other related materials, are protected by copyright, trademark, trade secret, and other intellectual property laws. All rights, titles, and interests in and to the App, including any updates or enhancements, remain the exclusive property of the Service Provider.

You are expressly prohibited from:

  • Copying, duplicating, or reproducing the App or any portion thereof without prior written permission from the Service Provider.
  • Modifying, altering, adapting, merging, translating, or creating derivative works based on the App or any of its components.
  • Attempting to extract or access the source code, algorithms, or architecture of the App, whether by reverse engineering, decompiling, or any other method.
  • Using, distributing, or displaying the Service Provider's trademarks, logos, or branding materials without authorization.
  • Removing, altering, or obscuring any copyright notices, proprietary labels, or other legal markings included in the App.

All trademarks, service marks, logos, and trade names appearing in the App are the property of their respective owners and are protected under applicable intellectual property laws. Nothing in these Terms shall be construed as granting, by implication or otherwise, any license or right to use any of the Service Provider's intellectual property without prior written consent.

The Service Provider reserves all rights not expressly granted under these Terms. Unauthorized use, copying, or modification of the App or its intellectual property may result in legal action and claims for damages. You agree to respect these ownership rights and use the App solely for its intended lawful purposes in accordance with this Agreement.

2. Modifications and Charges

The Service Provider is fully committed to ensuring that the Application provides a reliable, efficient, and valuable experience to all users. To maintain, improve, and expand the functionality, security, and overall performance of the Application, the Service Provider reserves the unconditional right to modify, enhance, update, or remove any part of the Application at any time and for any reason. Such modifications may include, but are not limited to, changes in the features, user interface, functionality, design, accessibility, content, technical architecture, or other aspects of the Application. These updates are intended to improve the overall user experience, address technical issues, comply with legal or regulatory requirements, or introduce new functionalities designed to better meet the needs of the user base.

The Service Provider also reserves the right to introduce fees, subscriptions, or other charges for access to certain features, commercial services, or additional content within the Application. Any such fees will be communicated clearly, prominently, and transparently to users before they are incurred. This ensures that users are fully aware of any costs associated with accessing specific functionalities or services. Information regarding payment methods, billing cycles, renewal terms, refund policies, and other related conditions will be provided in a manner consistent with applicable laws, industry standards, and best practices, ensuring full transparency in the financial aspects of the Application.

By continuing to access or use the Application after any modifications or introduction of charges, you acknowledge and accept such changes. If you do not agree with any modifications, updates, or newly implemented charges, you are advised to discontinue using the Application immediately and uninstall it from your device. Your continued use of the Application following any updates, modifications, or fee implementations constitutes your explicit acceptance of the revised terms, conditions, and applicable fees.

The Service Provider undertakes such modifications and adjustments in good faith, with the primary goal of improving usability, functionality, and service quality. Modifications may also be made to address security vulnerabilities, enhance performance, ensure compatibility with new operating systems or devices, or comply with evolving legal, regulatory, or industry standards. Users are encouraged to periodically check the Application for announcements, updates, or notifications regarding such changes.

Furthermore, any introduction of fees or charges will be done in a manner designed to provide users with sufficient notice and information, allowing them to make informed decisions regarding their continued use of the Application. The Service Provider may also introduce optional commercial features or subscription-based services to provide enhanced value, and such features will only be activated upon explicit consent or payment by the user.

The Service Provider reserves the right to terminate, restrict, or modify access to features or services as deemed necessary to maintain the integrity, security, and functionality of the Application. Such changes are implemented to safeguard both the user experience and the operational stability of the Application. Users are encouraged to stay informed and to review any notifications or updates to ensure continued understanding of how changes may affect their use of the Application.

3. User Responsibilities and Device Security

The Application stores, processes, and manages personal and usage data that you voluntarily provide to the Service Provider in order to deliver the services and functionality of the Application. As a user, you bear responsibility for maintaining the security, integrity, and confidentiality of your device, account credentials, and any information associated with your use of the Application. Ensuring that your device is secure and that access to the Application is properly controlled is essential for protecting your personal data and for ensuring the Application functions as intended.

It is the user's responsibility to prevent unauthorized access to their device and Application account. You should use strong, unique passwords, PINs, or biometric authentication methods to protect your account from unauthorized use. You are also responsible for logging out of your account after each session, keeping your login credentials confidential, and not sharing your account information with others. Failure to implement these measures may result in unauthorized access to your account or personal data, for which the Service Provider cannot be held liable.

The Service Provider strongly advises against jailbreaking or rooting your device. Jailbreaking or rooting refers to the removal or bypassing of software restrictions and limitations imposed by the official operating system. While these processes may provide users with additional control over their devices, they also introduce significant security risks. Jailbreaking or rooting can compromise the inherent security features of your device, making it more vulnerable to malware, viruses, malicious applications, or unauthorized access. These actions may also interfere with the normal operation of the Application, resulting in partial or complete malfunction, loss of data, or inability to access certain features.

By maintaining a secure device environment, users help protect not only their personal information but also the integrity and proper functioning of the Application. The Service Provider is committed to providing a secure, stable, and reliable application experience; however, it cannot guarantee the same level of protection if the device has been compromised, modified, or otherwise tampered with. Users acknowledge that any damage or disruption resulting from jailbreaking, rooting, or otherwise circumventing device security measures falls under the user's responsibility.

Additionally, users are encouraged to keep their device operating systems and installed applications up to date. System updates often include important security patches and bug fixes that help prevent unauthorized access, data breaches, and other security vulnerabilities. By regularly updating your device, you contribute to a safer, more secure environment for using the Application.

The Service Provider may provide additional recommendations, notifications, or instructions to maintain security and prevent misuse of the Application. Users agree to follow such guidance and to take reasonable precautions to safeguard their device and account information. By using the Application, you acknowledge your understanding of these responsibilities and agree to comply with best practices for device security, including avoiding unauthorized modifications and taking all necessary steps to prevent unauthorized access to your data.

4. Third-Party Services and Terms

Please note that the Application may utilize, integrate with, or rely upon third-party services, tools, platforms, or software components to provide certain features, functionalities, or infrastructure. These third-party services operate under their own Terms and Conditions, Privacy Policies, and usage agreements, which are separate and distinct from the terms outlined in this document. The Service Provider does not control these third-party services, and your use of such services may be subject to additional obligations or restrictions imposed by the respective providers.

The inclusion or integration of third-party services within the Application is intended to enhance the user experience, improve the functionality and performance of the Application, and enable features that the Service Provider alone may not be able to provide. Examples of such third-party services may include, but are not limited to, analytics platforms, cloud hosting providers, payment processors, messaging services, advertising networks, mapping or location-based services, and other software or service providers whose functionality is integrated into the Application.

By using the Application, you acknowledge and agree that your interactions with these third-party services are governed solely by the terms, conditions, and policies of the respective service providers. The Service Provider assumes no responsibility for any content, services, or data handling performed by third-party providers, and any disputes or issues that arise from your use of these services must be resolved directly with the third-party provider.

The Service Provider recommends that you review the Terms and Conditions and Privacy Policies of any third-party services used within the Application to fully understand how your data may be collected, used, shared, or stored by these providers. Links to these Terms and Conditions will be provided within the Application, documentation, or official website, wherever applicable. By continuing to use the Application, you are confirming your acknowledgment of these third-party agreements and your agreement to comply with all applicable rules and requirements imposed by these external service providers.

The Service Provider strives to select third-party services that meet high standards of security, reliability, and compliance with applicable laws. However, the Service Provider cannot guarantee the practices, policies, or security measures of these third-party providers. You are encouraged to exercise caution and take all necessary steps to protect your personal information when interacting with any external service through the Application.

The Service Provider may periodically update or change the list of third-party services integrated with the Application. Users are encouraged to review this section periodically for updates or additional links to the Terms and Conditions of newly integrated third-party providers. Continued use of the Application after any updates to third-party services constitutes your acknowledgment and acceptance of the applicable third-party terms and policies.

5. Third-Party Services – Specific Providers

The Application may utilize certain third-party services to enable specific features, improve performance, and enhance the overall user experience. By using the Application, you acknowledge and agree that the Service Provider does not assume responsibility for the functionality, security, or availability of these third-party services. These providers operate under their own Terms and Conditions and Privacy Policies, which govern your interaction with their services.

Google Play Services:

Some functions of the Application depend on Google Play Services. This includes functionality such as push notifications, location services, or device authentication. Please be aware that the Service Provider cannot guarantee full functionality if Google Play Services is unavailable, disabled, or incompatible with your device. Additionally, some features may require an active internet connection via Wi-Fi or a mobile network. The Service Provider is not responsible for any loss of functionality if your device lacks connectivity or if your mobile data allowance has been exhausted.

Google Tag Manager:

The Application may use Google Tag Manager to manage and deploy marketing tags, analytics, or other tracking codes efficiently. The Service Provider does not control the collection, storage, or use of data by Google Tag Manager. Your interactions with these tracking technologies are governed by Google's own policies and terms.

Google Analytics:

The Application may use Google Analytics to collect anonymous information about how users interact with the App, including usage statistics, session duration, pages or features accessed, and technical device information. Google Analytics is a third-party service, and the Service Provider cannot control or be held liable for the handling of data collected by Google Analytics. Users are encouraged to review Google's Terms of Service and Privacy Policy to understand how data is managed and used.

Firebase Cloud Messaging:

The Application may use Firebase Cloud Messaging (FCM) to deliver notifications, updates, and other communications directly to your device. The Service Provider relies on FCM to ensure timely delivery of messages; however, message delivery depends on factors such as device connectivity, battery status, and system restrictions. The Service Provider cannot guarantee uninterrupted delivery or functionality of FCM, and users acknowledge that certain delays or failures may occur beyond the Service Provider's control.

Cloudflare:

To enhance security, prevent abuse, and improve performance, the Application may use Cloudflare services. Cloudflare provides content delivery network (CDN) services, DDoS protection, and other security features. While these services help maintain the reliability and security of the Application, the Service Provider is not responsible for any interruptions, latency, or issues caused by Cloudflare or external network conditions. Users are encouraged to follow recommended security practices to ensure a safe experience.

By using the Application, you acknowledge and agree that the Service Provider is not liable for the performance, availability, security, or privacy practices of these third-party services. You also agree to comply with the respective Terms and Conditions and Privacy Policies of these providers when interacting with their services through the Application.

The Service Provider may integrate additional third-party services in the future to enhance functionality, optimize performance, or improve user experience. Updates regarding such integrations will be provided through the Application, and continued use of the Application will constitute acceptance of these new third-party service terms. Users are encouraged to regularly review this section to remain informed about third-party services utilized by the Application and their respective obligations.

6. Mobile Data Usage and Charges

By using the Application, you acknowledge and accept that certain features and functionalities require an active internet connection. While the Application can operate over Wi-Fi, it can also function using your mobile network provider's data services. When using the Application outside of a Wi-Fi area, you remain subject to the terms, conditions, and pricing policies of your mobile network provider. The Service Provider is not responsible for any data usage charges, overage fees, or additional costs incurred as a result of accessing the Application through your mobile network.

You acknowledge that using the Application over a mobile data connection may consume a significant amount of data, depending on the nature and frequency of the services you access, including but not limited to notifications, media downloads, analytics reporting, or content updates. You are solely responsible for monitoring your data usage and ensuring that you remain within the limits defined by your mobile network provider. Any fees, penalties, or additional charges resulting from exceeding your data allowance or roaming outside your home territory are your responsibility, and the Service Provider disclaims any liability for such charges.

If you use the Application while traveling internationally or outside your primary service area, your mobile network provider's roaming policies may apply. This may result in higher charges, including roaming fees or other supplemental costs associated with international data transmission. The Service Provider strongly advises users to review their mobile network agreement and disable data roaming if they wish to avoid such charges. By continuing to use the Application in such scenarios, you expressly agree to accept full responsibility for all incurred costs, including but not limited to roaming data charges, surcharges, or taxes.

If you are not the primary bill payer for the device on which the Application is being used, you represent and warrant that you have obtained the necessary consent from the bill payer to incur such charges. The Service Provider is not responsible for any disputes or issues arising between users and their mobile network providers regarding data usage, billing, or other charges. Users are solely responsible for resolving any such disputes directly with their provider.

The Service Provider recommends that users monitor their data usage and adopt measures to minimize unnecessary consumption, such as connecting to Wi-Fi networks whenever possible, limiting background data usage, and reviewing the Application's settings to control data-intensive features. Taking these precautions can help prevent unexpected charges and ensure a more cost-effective and seamless experience with the Application.

By using the Application over a mobile network, you accept and acknowledge that the Service Provider does not control the rates, billing practices, or service limitations of your mobile provider. Users bear full responsibility for any financial obligations incurred, whether for routine data consumption, roaming usage, or other third-party charges associated with connectivity. Continued use of the Application under these conditions constitutes your agreement to assume all such responsibilities and to hold the Service Provider harmless from any claims, disputes, or liabilities relating to mobile network usage.

7. User Responsibility for Device Power and Access

While the Service Provider strives to ensure that the Application operates efficiently and continuously, it is important to understand that certain aspects of your usage are entirely within your control and responsibility. Among these responsibilities is the need to maintain your device's power supply. You acknowledge and agree that the Service Provider cannot guarantee uninterrupted access to the Application if your device is not adequately charged, powered on, or capable of operating due to low battery or hardware limitations.

You are solely responsible for ensuring that your device has sufficient battery life to access and use the Application as needed. Failure to maintain adequate power on your device may result in temporary or complete inability to use the Application, interruption of services, or loss of unsaved data. The Service Provider expressly disclaims any liability for any inconvenience, loss of functionality, or data loss resulting from your device running out of battery or otherwise being inoperable.

Additionally, the Service Provider cannot control external factors that may prevent access to the Application, including but not limited to network outages, device malfunctions, operating system errors, or technical issues unrelated to the Application itself. Users are responsible for maintaining their device in good working order, installing necessary updates, and following manufacturer guidelines to ensure proper functionality. By failing to maintain your device, you assume all risks associated with inaccessibility or service interruptions.

It is also the responsibility of the user to anticipate situations in which device power may be limited, such as during travel, outdoor use, or prolonged periods away from a power source. Users should plan accordingly, including charging their devices in advance or having access to backup power solutions, to avoid disruption of Application usage. The Service Provider will not be liable for any inconvenience, data loss, missed notifications, or inability to use features due to insufficient device power.

Furthermore, the Service Provider encourages users to implement best practices to maintain continuous access to the Application, including keeping devices fully charged, monitoring battery levels regularly, and avoiding prolonged use in situations where device power may be insufficient. Users are also responsible for ensuring that other device-dependent conditions, such as adequate storage, updated operating systems, and functional hardware components, are met to allow the Application to operate properly.

8. Service Provider Liability and Third-Party Information

While the Service Provider is dedicated to ensuring that the Application is reliable, functional, and provides accurate information, it is important to recognize that certain features of the Application rely on information provided by third-party sources. This includes, but is not limited to, content, data, analytics, or other information that may be necessary to deliver specific functionalities within the Application. The Service Provider acts as a facilitator, making this information available to you through the Application; however, the Service Provider does not control the accuracy, completeness, timeliness, or reliability of such third-party information.

By using the Application, you acknowledge that any reliance on information obtained from third-party sources is at your own risk. The Service Provider does not guarantee that all information displayed or accessed through the Application is complete, up-to-date, or free from errors. You agree that the Service Provider cannot be held responsible or liable for any loss, damage, or inconvenience—whether direct, indirect, incidental, or consequential—arising from your reliance on this information.

The Service Provider makes reasonable efforts to select reputable and trustworthy third-party providers; however, the inclusion of third-party information does not constitute an endorsement, verification, or guarantee of its accuracy or completeness. Users are strongly advised to exercise independent judgment and discretion when interpreting or acting upon any information obtained through the Application. You should verify any critical information through your own sources before making decisions based upon it.

Additionally, the Service Provider disclaims any liability for delays, errors, omissions, or interruptions that may occur due to the transmission, delivery, or processing of third-party information. The Service Provider does not control, endorse, or guarantee the availability, accuracy, or security of data or content provided by third parties. As such, users accept that certain information may be incomplete, delayed, modified, or removed by the original provider without notice, and the Service Provider is not responsible for any consequences resulting from such changes.

By using the Application, you expressly agree that the Service Provider shall not be liable for any claims, damages, losses, or costs resulting from your use of third-party information, including but not limited to financial, reputational, or operational impacts. This limitation of liability applies regardless of whether such losses arise from errors, omissions, misrepresentations, or inaccuracies in the information provided by third parties.

9. Updates, Availability, and Termination

The Service Provider may, from time to time, release updates, enhancements, or modifications to the Application in order to improve functionality, security, and overall user experience. These updates may include, but are not limited to, bug fixes, new features, performance improvements, design changes, and compatibility adjustments to support newer versions of operating systems or devices. By using the Application, you acknowledge and agree that it may be necessary to download and install these updates to continue accessing the full functionality of the Application.

While the Service Provider strives to maintain and enhance the Application regularly, it does not guarantee that updates will be provided consistently, nor does it guarantee that all updates will be compatible with your specific device or operating system version. Users acknowledge that their continued access to or use of the Application may depend on maintaining compatibility with updates and system requirements, and the Service Provider disclaims any liability for any interruption, reduced functionality, or incompatibility that may arise if updates are not installed.

You agree to accept and install updates when offered, as refusal to do so may result in limited functionality or inability to access certain features. By accepting updates, you acknowledge that the Application may change in appearance, performance, or behavior from its previous version. Such changes are intended to enhance your experience and improve security, and users agree to comply with all updated terms, functionalities, and system requirements associated with these updates.

The Service Provider may, at its sole discretion, decide to discontinue the provision of the Application, temporarily or permanently. Termination of the Application or its services may occur without prior notice, although the Service Provider may provide notification when feasible. Users acknowledge that upon any termination of service:

  • (a) All rights and licenses granted to you under these Terms and Conditions will immediately cease;
  • (b) You are required to stop using the Application in all forms;
  • (c) You must, if necessary, delete the Application and any associated data from your devices;
  • (d) The Service Provider is not responsible for any loss of access, data, or functionality following such termination.

Termination may occur for various reasons, including but not limited to discontinuation of support for specific devices or operating systems, regulatory compliance requirements, or strategic business decisions. Users understand that the Service Provider is under no obligation to maintain the Application indefinitely and that continued use is contingent upon compliance with updates, system requirements, and other operational considerations determined by the Service Provider.

10. Changes to These Terms and Conditions

The Service Provider reserves the right to update, amend, or modify these Terms and Conditions at any time, in its sole discretion. These updates may be necessary to reflect changes in legal requirements, regulatory compliance, technological advancements, new features or functionalities of the Application, or other operational considerations. By continuing to use the Application, you acknowledge and agree that you are bound by the most current version of these Terms and Conditions, and it is your responsibility to review this page regularly to stay informed about any changes.

The Service Provider will make reasonable efforts to communicate significant updates or modifications to users. Such notifications may include posting the revised Terms and Conditions on the official page within the Application, sending notifications through in-app messaging, or providing email communication where applicable. However, the Service Provider is not obligated to notify each user individually, and your continued use of the Application following any update constitutes your acceptance of the modified Terms and Conditions.

Users are strongly encouraged to review these Terms and Conditions periodically to understand how changes may impact their use of the Application, rights, responsibilities, and obligations. Updates to these Terms may include, but are not limited to, revisions to license grants, user responsibilities, privacy practices, liability limitations, subscription or fee structures, and other operational policies. The Service Provider may also update the Terms and Conditions to address evolving technological, regulatory, or legal requirements, including compliance with applicable privacy, data protection, and consumer protection laws. Users are responsible for understanding these changes and ensuring continued compliance when using the Application. Continued use of the Application after updates demonstrates your understanding that the Service Provider may change the terms in its discretion and that you accept the most current version of the Terms and Conditions.

These Terms and Conditions are effective as of October 17, 2025, and will remain in effect until they are updated, amended, or replaced in accordance with the provisions outlined in the "Changes to These Terms and Conditions" section. By accessing or using the Application from this effective date onward, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions, including any updates that may occur in the future.

The effective date represents the point from which the Service Provider's obligations, user responsibilities, and the rights and restrictions described herein take legal effect. Users who began using the Application prior to this date are also expected to comply with these Terms and Conditions as of this effective date. Your continued use of the Application signifies your acceptance of these terms, regardless of when you first installed or accessed the Application.

It is your responsibility to review and understand the Terms and Conditions, as any use of the Application on or after the effective date constitutes acknowledgment of your agreement to be legally bound by them.
